Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and Gridware Services LLC, a New Mexico limited liability company and the parent company that operates the CheckYoSelf product ("Gridware," "CheckYoSelf," "we," "us," or "our"). They govern your access to and use of checkyoself.app and related services (the "Service").

Please read Section 14 carefully: it requires most disputes to be resolved by binding individual arbitration and waives your right to a jury trial and to participate in a class action.

1. Acceptance and Eligibility

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a legally binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

CheckYoSelf is software for generating printable check PDFs that you print yourself — on plain paper for mobile deposit, or on check stock. We provide the software only. We are not a bank, money transmitter, payment processor, or financial advisor, and we do not move, hold, verify, or guarantee any funds or any account.

3. Accounts and Security

Authentication is provided through our identity provider. You are responsible for maintaining the security of your sign-in method and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion.

4. Use at Your Own Discretion; Acceptable Use

You use the Service entirely at your own discretion and risk. A check is a legal financial instrument, and you are solely responsible for every check you create — the payee, amount, date, memo, and the routing and account numbers — and for confirming that each one is accurate, authorized, and lawful. You agree that you will not:

• create a check drawn on any account you are not authorized to use, or with any intent to defraud;
• use the Service for any unlawful, deceptive, or fraudulent purpose, or in violation of any banking law, rule, or your bank’s policies;
• infringe others’ rights, upload malicious code, or attempt to disrupt or gain unauthorized access to the Service;
• reverse engineer, scrape, resell, or build a competing product from the Service.

You are liable for all checks created through your account.

5. Free Accounts: No Guarantee, No Support

Free (non-paid) accounts may print up to ten checks per calendar month. The free tier is provided strictly "as is" and "as available," with zero guarantee of any kind — no promise of uptime, availability, accuracy, data retention, or fitness for any purpose — and with zero support beyond the self-serve information published on this site. We are under no obligation to respond to inquiries from free accounts.

6. Paid Accounts, Credits, and Billing

Beyond the monthly free allotment, checks are priced per check and paid from prepaid credits purchased through our payment processor, Stripe. Credits are billed in advance, are consumed as you print, and are non-refundable except where required by law. You are responsible for any applicable taxes. Prices and free allotments may change on notice; continued use after a change means you accept it. Paid accounts get access to email support at support@checkyoself.app on a best-effort basis (typically one to two business days); support is a courtesy, not a guaranteed service level.

7. Marketing Communications

By providing your contact information, you agree that we, our parent company Gridware Services LLC, and our direct-marketing partners may send you marketing and promotional communications, as described in our Privacy Policy. You can opt out of marketing at any time using the unsubscribe link in any message or by emailing support@checkyoself.app. Transactional and account messages are not marketing and will continue regardless.

8. Intellectual Property

We and our licensors own the Service, including its software, design, and trademarks; we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of the check and account information you enter, and you grant us a license to process it solely to provide the Service.

9. Third-Party Services

The Service relies on third parties — including Stripe (payments), Convex (data storage), and our authentication provider. Your use of those features may also be subject to their terms, and we are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CHECK WILL BE ACCEPTED OR PROCESSED BY ANY BANK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRIDWARE SERVICES LLC AND ITS AFFILIATES, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE — INCLUDING ERRORS IN GENERATED CHECKS OR CHECKS THAT ARE DELAYED, REJECTED, OR MISPROCESSED BY ANY BANK. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12. Indemnification

You agree to indemnify and hold harmless Gridware Services LLC and its affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the checks you create, or your violation of these Terms or any law.

13. Term and Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without cause. Sections that by their nature should survive termination — including Sections 4, 6, 8, 10–14, and 16 — will survive.

14. Dispute Resolution; Binding Arbitration; Class Action Waiver

Informal resolution first. Before filing a claim, you agree to contact us at support@checkyoself.app and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve a dispute informally, you and we agree that any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Class action and jury waiver. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. You and we waive any right to a jury trial.

Exceptions and opt-out. Either party may bring a qualifying claim in small-claims court, and either party may seek injunctive relief for intellectual-property misuse. You may opt out of this arbitration agreement by emailing support@checkyoself.app within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 14. Subject to Section 14, the state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute not subject to arbitration.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them to an affiliate or successor. Our failure to enforce a provision is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control. You consent to receive communications and notices from us electronically.
